Terms of Service

By inviting the Fus1onOverseer Discord bot to a server, creating an account, purchasing a license, or otherwise using Fus1onOverseer (the "Service"), operated by Fus1on Studios, a company owned and operated in Canada ("we," "us," "our"), you agree to these Terms of Service. If you don't agree, don't use the Service.

Fus1onOverseer is a multi-guild Discord moderation, ticketing, and community-management bot with an accompanying web control panel, offered on a licensed, tiered-subscription basis. The Service is under active development - features, limits, and pricing may change, and we'll do our best to communicate significant changes.

You sign in with a linked Discord account and a Fus1on Studios (fus1on.host) account. You're responsible for keeping your credentials secure and for all activity under your account. Tell us right away if you suspect unauthorized access.

Paid tiers are billed through Stripe on a recurring subscription basis unless explicitly sold as a one-time lifetime license. Subscriptions renew automatically until cancelled; you can manage or cancel from the Billing page's Stripe portal link at any time. Except where required by law, payments are non-refundable, but reach out via Contact Us or a support ticket if something's gone wrong - we handle these case by case.

A license key activates the Service on up to your tier's server limit. Lifetime (non-expiring) keys may be transferred to another Discord account by the current paying customer; subscription-based keys, tied to a Stripe payment method, may not. We may revoke a key obtained fraudulently or in violation of these Terms.

You agree not to:

• Use the Service for anything illegal, or to violate Discord's own Terms of Service or Community Guidelines.
• Attempt to bypass, disable, or reverse-engineer license enforcement or other access controls.
• Abuse, spam, or overload the Service, including automated bulk actions outside normal use.
• Resell, sublicense, or redistribute access to the Service except through the official Reseller Program.

Reseller applications are reviewed and approved at our discretion. Approved resellers purchase license keys at a wholesale discount and may set their own pricing, bundling, and terms with their own customers, with one condition: keys may not be resold below our then-current public list price for the equivalent plan, including subscription pricing, as shown on our Pricing page. Resellers are independent - you're responsible for your own customer relationships, support, and any refunds you offer, unless we've separately agreed otherwise in writing. We may suspend or revoke reseller status for violating this section.

Content you submit - support tickets, bug reports, suggestions, contact form messages, reviews - may be used to operate, provide support for, and improve the Service, including sharing bug reports and their status publicly (e.g. the public bug tracker and its Discord sync) without attribution beyond what you provided.

The Service relies on Discord, Stripe, MongoDB Atlas, Resend, and DeepL, among others, each governed by their own terms. We aren't responsible for their availability or conduct.

Fus1on Studios owns the Service and all associated software, branding, and content. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service per your license tier - nothing more.

We may suspend or terminate access for violating these Terms, non-payment, or abuse of the Service. You may stop using the Service, deactivate your license, or delete your account at any time.

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Fus1on Studios is not liable for any indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

We may update these Terms as the Service evolves. Material changes will be reflected by an updated "Last updated" date above; continued use after a change means you accept the updated Terms.

These Terms are governed by the laws of Canada and the province in which Fus1on Studios operates, without regard to conflict-of-law principles. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of that province.
